At KO-36 we take the protection of your data seriously. This Privacy Policy explains who is responsible for your information, what we use it for, on what legal basis, how long we keep it, and what rights you have over it.

2. What personal data do we collect?
We only collect your email address, which you provide voluntarily when you sign up for the KO-36 waitlist.
We do not request or collect any other personal data through this form.
3. Why do we process your data?
We process your email address in order to:
- Manage your waitlist registration for KO-36.
- Send you communications about KO-36: product news, launch announcements, information about our Kickstarter campaign, and other updates related to the console.
We do not use your data to create profiles or to make automated decisions that produce legal effects on you.
4. What is the legal basis for processing your data?
The legal basis is your consent (Article 6.1.a of the General Data Protection Regulation), which you give expressly when you provide your email address and accept this Privacy Policy.
You may withdraw your consent at any time, without affecting the lawfulness of processing carried out before its withdrawal. To do so, you can use the unsubscribe link included in each of our emails or write to us at koboss@getko36.com.
5. How long do we keep your data?
We will keep your email address for as long as you do not withdraw your consent or request to unsubscribe.
Once you unsubscribe, your data will be blocked and kept, duly protected, only for the periods legally required to address any potential liabilities. After those periods, it will be permanently deleted.
6. Who do we share your data with?
In order to manage the sending of our communications, we use the email marketing platform Sender, operated by:
- UAB Sender.lt — Lvivo st. 25, Vilnius (Lithuania).
Sender acts as a data processor, processing your data solely in accordance with our instructions and with the General Data Protection Regulation, under the corresponding data processing agreement. As it is a provider established in the European Union, your data is hosted and processed within the European Economic Area.
We do not share your data with any other third party, except where legally required.
7. International data transfers
As a general rule, your data is processed within the European Economic Area (EEA).
In the event that any of our providers were to involve a transfer of data outside the EEA, such transfer would always be carried out with the appropriate safeguards provided for in the General Data Protection Regulation, such as the Standard Contractual Clauses approved by the European Commission.
8. What are your rights?
You have the right to:
- Access your personal data.
- Request the rectification of inaccurate data.
- Request the erasure of your data.
- Request the restriction of processing.
- Object to the processing.
- Request the portability of your data.
- Withdraw the consent given at any time.
You can exercise these rights by writing to koboss@getko36.com, indicating the right you wish to exercise.
Likewise, if you believe that the processing of your data does not comply with the applicable regulations, you have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD) through its electronic office (www.aepd.es).
9. Cookies
The KO-36 website does not use analytics, advertising, or tracking cookies. Only the strictly necessary technical cookies required for the proper functioning of the site are used, where applicable.
10. Changes to this Privacy Policy
We may update this Privacy Policy to adapt it to legislative developments or to changes in the way we process data. We will always publish the current version, indicating its last updated date at the top.
